Terms of Service

These Terms govern your use of the Propwash website, Owner Portal, and mobile app (together, the “Services”). Your signed Vessel Service Agreement governs the detailing service itself and controls if the two ever conflict.

1Acceptance

By using the Propwash website (propwashmarine.com), Owner Portal, or mobile app (together, the “Services”), you agree to these Terms. If you don’t agree, don’t use the Services.

2Who can use the Services

You must be at least 18 years old and able to enter a binding contract. If you use the Services on behalf of a vessel owner, you confirm you’re authorized to do so.

3What we provide

Propwash Marine Detailing LLC provides boat and yacht detailing and related services in South Florida, and the online tools to book, track, and pay for them. The Services let you request quotes, manage memberships, view service records and photos, report a spot on your vessel, communicate with us, and make payments.

4Your account

You’re responsible for keeping your login credentials secure and for activity under your account. Tell us right away if you suspect unauthorized use. Keep your account information accurate and current.

5Relationship to your Vessel Service Agreement

If you enroll in a membership or book contracted work, your signed Vessel Service Agreement sets the specific terms of that service — scope, pricing, term, renewal, and cancellation. These Terms cover your use of the Services generally. Where the two conflict about the detailing service, the Vessel Service Agreement controls.

6Quotes, Bookings, and "Report a Spot"

Quotes are estimates based on the information and vessel condition described; final pricing may change if actual conditions differ, and we’ll tell you before doing additional work. Reporting a spot through the portal or app is always free; only the work is priced.

7Payments

Payments are processed by Stripe. By providing a payment method, you authorize us to charge it for the services and amounts shown, including applicable taxes. You agree the payment details you provide are accurate and that you’re authorized to use the payment method. Past-due balances may pause service and are handled as described in your Vessel Service Agreement and our Refund & Cancellation Policy. We also accept certain manual payment methods (e.g., Venmo/Zelle) where offered; those are recorded manually by us.

8Memberships and automatic renewal

Memberships run for the term you select and, unless you tell us otherwise in writing before renewal, renew automatically for the same tier and length. We remind you at least 30 days before renewal. You can change tiers or cancel as described in your Vessel Service Agreement and our Refund & Cancellation Policy. Rate changes take effect only at renewal, with at least 30 days’ notice.

9Cancellations and refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy and your Vessel Service Agreement, which are incorporated into these Terms.

10Your content and photos

You keep ownership of photos and content you submit. You grant us permission to use them to provide and document your service. We use photos of your vessel for marketing only with your separate permission (see the Privacy Policy). Don’t submit content you don’t have the right to share, or anything unlawful or infringing.

11Acceptable use

Don’t misuse the Services: no attempting to breach security, disrupt the Services, access others’ accounts, scrape or copy the Services, or use them unlawfully.

12Intellectual property

The Propwash name, logo, website, portal, app, and their content are owned by Propwash or its licensors and protected by law. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. Don’t copy, modify, or redistribute them without permission.

13Third-party services and app stores

The Services depend on third parties (for example, Stripe and the Apple App Store), and your use may be subject to their terms. If you download the app from the Apple App Store, Apple’s standard licensed-application terms also apply, Apple is not responsible for the app or support for it, and Apple is a third-party beneficiary of these Terms entitled to enforce them.

14Disclaimers

Except as expressly stated in your Vessel Service Agreement, the Services and the website/app software are provided “as is” and “as available,” without warranties of any kind, to the fullest extent allowed by law. We don’t promise the Services will always be uninterrupted or error-free.

15Limitation of liability

To the fullest extent allowed by law, Propwash is not liable for indirect, incidental, special, or consequential damages arising from your use of the Services, and our total liability relating to the Services (as distinct from the detailing service, which is governed by the Vessel Service Agreement) is limited to the amount you paid us for the Services in the 12 months before the claim.

16Indemnification

You agree to cover claims and costs arising from your misuse of the Services or your breach of these Terms, to the extent allowed by law.

17Governing law and disputes

These Terms are governed by the laws of the State of Florida. If a dispute arises, we’ll first try to resolve it directly; if we can’t, either of us may request mediation before going to court. Any legal action will be brought in the courts of Palm Beach County, Florida, and small claims court remains available for qualifying claims. The prevailing party may recover reasonable attorneys’ fees and costs.

18Changes to these Terms

We may update these Terms. We’ll post the updated version with a new “Last updated” date and, where appropriate, notify you. Continuing to use the Services after changes means you accept them.

19Termination

You may stop using the Services at any time. We may suspend or end access if you violate these Terms or to protect the Services or others. Provisions that by nature should survive (such as payment, intellectual property, disclaimers, and dispute terms) survive termination.
